Peter, a Design Engineer was was born and raised in the U.S, met Amy, a secretary from Hong Kong, while studying for his Master’s degree in England. They lived in the same student housing, and within one month of meeting, they started dating. Peter brought Amy to London for the holidays, and shortly after flew to Hong Kong to celebrate the Chinese New Year with Amy and her family in January 2020.
However, their plans faced a challenge when the COVID pandemic hit. Amy was not able to travel to see Peter until a year later in May 2021, and it was during this visit that they realized they wanted to get married.
When Peter and Amy reached out to our office, we immediately started coming up with a strategy to ensure the success of their case. As they were only engaged, we proceeded with a Fiancé Visa, also known as the K-1 visa. This visa is specifically designed for U.S. citizen’s foreign fiancés, allowing them to enter the U.S. and get married upon arrival. To ensure there was no room for a denial, we crafted a comprehensive application, including detailed affidavits from Peter about the history and depth of their relationship, and affidavits from both of them in regards to their commitment to marriage. We gathered their biographical information, flight itineraries, Amy’s visa details, travel history and photos together. Each piece of documentation was carefully reviewed and organized to demonstrate the bona fide nature of their relationship.
After one and a half years of filing their I-129F petition, it was approved! Amy now had to wait for her interview appointment ay the U.S. Embassy in Hong Kong. Once she had her interview, the officer approved her visa application and with this approval she was allowed to travel to the U.S. and marry Peter.
It’s important to know that once the immigrant enters the U.S. they have 90 days to get married to their U.S. citizen spouse. It was critical that our clients followed these rules because if they didn’t, we would have to refile the entire petition again.
It was time for us to transition Amy from a K1 visa to green card, as she was now married to her U.S. citizen spouse. We promptly filed Amy’s Adjustment of Status, providing proof proof that they had gotten married in good faith and ensuring Peter’s financial capacity to support Amy without replying on government assistance.
Six month later, Amy received her green card!
