From Oil Rigs to Roots: A Journey to U.S. Residency and Love

Background

Within the past seven years, we have worked with our client Claus. He came to the U.S. on an H-2B visa in 2017. This visa allowed Claus to take on the demanding role of an oil rigger in the oil industry, where he constantly traveled across the country, relocating every six months. As an oil rigger, he was in charge of working on offshore and onshore drilling rigs to extract oil. This job was very demanding, and he was specifically in charge of regular maintenance and repair of drilling equipment and machinery, while also monitoring pressure levels, drill depth and other metrics to ensure the safety of everyone while drilling. Throughout this time, his girlfriend was living with him and supporting him as they navigated this lifestyle of constantly relocating.

Case

As time passed, Claus realized he wanted to permanently reside in the U.S. with his partner. He longed to build a stable life with his partner, free from the uncertainties of constant relocations and visa renewals. With no family or close friends, their bond was strong. The goal was to transition Claus from an H-2B visa to a green card. Typically, many oil riggers are initially hired on an H-2B visa, which allows temporary non-agricultural work in the U.S. The next steps were to frame a pathway to permanent residency.

We helped Claus get an EB-3 visa, which allowed foreign workers to work and live in the U.S., as well as apply to live in the U.S. permanently. In January 2024, Claus and his partner married, setting the stage for their journey toward living life together. One month later, we promptly began working on the green card application. Shortly afterwards, everything was submitted and within 2 weeks of filing we received his work permit (EAD).

Issue

However, USCIS issued a Request for Evidence (RFE), questioning the legitimacy of Claus and his partner’s marriage. The government aimed to ensure that their marriage wasn’t solely for immigration purposes. Even though they had been together for years, but were only married for a couple of months, USCIS wanted further information. Anticipating this, we had already observed a trend of increased scrutiny from USCIS for newlywed couples, even those in genuine relationships.

 

Regardless, we gathered substantial evidence to demonstrate the authenticity of Claus’s marriage. Within a week, we compiled a comprehensive package including:

  1. Drivers Licenses showing their shared addresses
  2. Joint bank statements
  3. Auto insurance policies
  4. A life insurance application
  5. Joint credit card and utility bills

Verdict

Thanks to our thorough preparation and quick response, USCIS approved Claus’s green card in just one month after we submitted the RFE response.
